Terms of Use

1. Acceptance of terms

These Terms of Use ("Terms") govern your use of the Fountain mobile application (the "Service"), developed by Andrew Schauer ("Fountain," "we," "us," or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms apply alongside our Privacy Policy, which explains how we handle your personal data.

Fountain is currently distributed only to a small group of invited testers via Apple TestFlight and is not available on the public App Store.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service. By using Fountain, you represent that you meet this requirement. This age restriction reflects both our own policy and the requirements of third-party services Fountain relies on, including Plaid's terms for linking financial accounts.

Fountain is intended for use by residents of the United States. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with any applicable local laws.

3. Your account

3.1 Registration

To use Fountain, you must create an account using a valid email address. You are responsible for keeping your contact information current and for all activity that occurs under your account.

3.2 Account security

You are responsible for maintaining the security of your device and your access to the Service. If you enable biometric app lock (Face ID or Touch ID), that lock is a local device control only — it does not constitute account-level authentication or protect your account if someone accesses it from another device. Notify us atsupport@fountain-money.com if you believe your account has been compromised.

3.3 One account per person

Fountain accounts are personal and non-transferable. You may not share your account with others or create accounts on behalf of anyone else.

4. The Service

4.1 What Fountain does

Fountain is a personal finance tracking tool. It connects to your financial accounts (via Plaid) to display balances, transactions, and investment data in one place, and provides planning tools such as emergency fund tracking and checking account targets.

4.2 Not financial advice

Fountain is not a financial advisor, broker, or investment advisor, and nothing in the Service constitutes financial, investment, tax, or legal advice. The information displayed in the app — including account balances, transaction history, investment holdings, and any planning calculations — is provided for informational purposes only. You should consult a qualified professional before making any financial decision.

4.3 Data accuracy

The financial data shown in Fountain is retrieved from your financial institutions via Plaid. We do not independently verify this data and cannot guarantee that it is complete, accurate, or current. Balances and transaction records may be delayed or differ from those shown on your institution's own platform. Do not rely solely on data in Fountain for financial decisions.

4.4 No money movement

Fountain is a read-only tool. We do not initiate, authorize, or process any financial transactions on your behalf. We never move, hold, or have access to your funds.

5. Linked financial accounts

5.1 Plaid

When you connect a financial account, you are using Plaid Inc.'s services to establish and maintain that connection. By linking an account, you agree to Plaid'sEnd User Privacy Policy and authorize Plaid to access your financial account data on your behalf.

5.2 Your responsibility

You represent that you are the authorized account holder (or an authorized user) of any financial account you link to Fountain. You must not link accounts you are not authorized to access.

5.3 Disconnecting accounts

You may disconnect any linked account at any time from within the app. Disconnecting an account revokes Fountain's and Plaid's access to that account going forward; it does not delete historical data already synced. To delete all synced data, delete your account (see Section 9).

6. Subscription and billing

Fountain may offer a free trial period followed by a recurring paid subscription. All billing is handled through Apple's App Store in-app purchase system. Fountain does not collect or store your payment information.

• Free trial: If a free trial is offered, it will begin on the date you subscribe and automatically convert to a paid subscription at the end of the trial period unless you cancel before it expires.
• Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until then.
• Refunds: All refund requests are handled by Apple in accordance with their policies. Fountain does not issue refunds directly.
• Price changes: We will give you reasonable advance notice of any subscription price change.

7. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to the Service, its backend systems, or another user's account
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to link financial accounts you are not authorized to access
• Interfere with or disrupt the integrity or performance of the Service
• Use automated tools (bots, scrapers, etc.) to access or extract data from the Service
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

8. Intellectual property

The Service, including its design, code, and content, is owned by Andrew Schauer and protected by applicable intellectual property laws. These Terms do not grant you any ownership interest in the Service.

The name "Fountain" and any associated logos or marks are the property of Andrew Schauer.

9. Account deletion and termination

9.1 Deletion by you

You may delete your account at any time from within the app. Deletion is immediate and irreversible — all your personal data will be permanently removed from our systems (see the Privacy Policy, Section 6, for full details). If you have an active subscription, cancel it before deleting your account; deleting your account does not automatically cancel an Apple subscription.

9.2 Termination by us

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. Because Fountain is currently an invitation-only TestFlight build, access may be revoked at any time.

9.3 Effect of termination

Upon termination, your right to use the Service ceases immediately. Sections 4.2 (not financial advice), 8 (intellectual property), 10 (disclaimers), 11 (limitation of liability), 12 (indemnification), and 13 (governing law) survive termination.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY FINANCIAL DATA DISPLAYED IN THE SERVICE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANDREW SCHAUER AND FOUNTAIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless Andrew Schauer and Fountain from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third party's rights.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or the Service shall be resolved in the courts located in Los Angeles County, California, and you consent to personal jurisdiction there.

For informal disputes, we encourage you to contact us first atsupport@fountain-money.com — most issues can be resolved without formal proceedings.

14. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email and/or an in-app notice before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. The "Last updated" date at the top reflects the most recent revision.
